COMMUNIQUE ON IMPLEMENTING SUPERVISION ON IMPORT

(COMMUNIQUE NO: 2017/8)

Scope

ARTICLE 1 – (1) This Communiqué contains the procedures and principles related to the implementation of supervision that will be carried forward on the importation of goods (whit unit values below the customs value shown below) of which the customs tariff statistical position (HS Code) and description are given below. These procedures and principles are not valid for goods Iranian origin.

Supervision

ARTICLE 2 - (1) The goods referred to in Article 1 of this Communiqué shall be imported only with the Supervision Certificate  to be issued by the Ministry of Economy (General Directorate of Importation). The Supervision Certificate is sought by the customs authorities in the registration of the customs declaration. The 23- digit document number and the document date which will be provided by the Single Window System for the Supervision Certificates will be declared in the "Document Reference Number" and "Document Date"  fields of the box number 44 of the declaration.

 

Application

ARTICLE 3 - (1) In order for the applications on requests for the Supervision, the “Supervision Certificate Application Form" in Annex-1 must be submitted to the General Directorate of Imports  with the forms and documents in Annex 2.

 

Review

ARTICLE 4 - (1) Additional information and documents may be required if the information and documents deemed necessary or transmitted to the General Directorate of Importation are found to be contradictory.

 

Sanction

ARTICLE 5 - (1) In case the documents requested during the application or review phase are found to be inconsistent or deficient in tinformation  or untrue or false, the Supervision Certificate shall not be issued.

 

Information on supervision certificate and use of the supervision certificate

ARTICLE 6 - (1) Supervision certificates have a validity period of six months.

(2) The Supervision Certificate does not prevent the execution of the  customs value provisions of the Customs Law dated 27/10/1999 and numbered 4458. The value stated in item 1 does not constitute the basis for the execution of the customs value provisions of the customs law numbered 4458.

(3) In cases where the value or amount determined by customs during the registration of customs statements exceeds the registered amount or value in the registration documents in less than 5 % (including 5 %), this will not be considered as a barrier on import.

Abolished Communique

ARTICLE 7- (1) The Communique on Implementing Supervision on Import which was published on Official Gazette numbered 27210, dated 24.01.2009 (Communique No: 2009/2) is abolished.

 

Enforcement

Article 8 –  (1) This Communiqué enters into force on the 30th day of its publication.

 

Execution

Article 9 –  (1) The provisions of this Communiqué are executed by the Minister of Economy.
